Among disposable e-cigarette products, those with flavors other than tobacco accounted for 94.7% of the market in 2023.

Research published in 2019 indicated many e-cigarette brands, including the popular JUUL brand, were specifically designed to be as addictive as Marlboro cigarettes, leading a new generation to nicotine addiction. Recent studies indicate disposable e-cigarettes are linked to higher vape rates among teens in the U.S. Teens and young adults who use them are more likely to keep vaping and vape more frequently. Even with these caveats, these findings warrant urgent attention from state agencies to enforce the ban on flavored e-cigarette products in California.

In this regard, either it was detected at concentrations that did not exceed the authorised limit [73], or it was absent from the aerosols produced [4, 71, 72]. Only one study revealed its presence at high concentration in a very low number of samples [5]. Nevertheless, its presence above 1 mg/g is not allowed by the FDA [73]. Figure 1 lists the main compounds detected in aerosols derived from humectant heating and their potential damaging effects. It would seem that future studies should analyse the possible toxic effects of humectants and related products at concentrations similar to those that e-cigarette vapers are exposed to reach conclusive results. It is well known that nicotine is extremely addictive and has a multitude of harmful effects.

E-cigarette devices can be used to deliver marijuana and other drugs. Results from in vitro studies are in general agreement with the limited number of in vivo studies. For example, in an analysis using primary human umbilical vein endothelial cells (HUVEC) exposed to 11 commercially-available vapours, 5 were found to be acutely cytotoxic, and only 3 of those contained nicotine [24]. In addition, 5 of the 11 vapours tested (including 4 that were cytotoxic) reduced HUVEC proliferation and one of them increased the production of intracellular reactive oxygen species (ROS) [24]. Three of the most cytotoxic vapours—with effects similar to those of conventional high-nicotine CS extracts—also caused comparable morphological changes [24].

Often marketed as a safer alternative to tobacco cigarettes, virtually all vaping liquids contain highly addictive nicotine. Resources are available to schools and families to help them identify vape devices, how they’re used, and the safety and health risks they present.

For example, tobacco-flavored e-cigarette cartridges sales dropped from 47.2% of those sold or given away in 2015 to 21% in 2018, while the sale of “other” flavored cartridges tripled in that time, increasing from 13.8% in 2015 to 42.1% in 2018. The age restriction (21+) has only created an entrepreneurial opportunity. Kids are buying e-juice, filling cartridges and selling them to others not able to obtain product on their own. Indeed, the “vapor” may have a lot more than those five ingredients listed above. Some studies have found it to contain lead, nickel, tin, and silver from the machinery inside the devices along with formaldehyde, manganese, tolulene, and other ingredients linked to cancer, central nervous system problems, and other possible health issues. A 2018 study of e-cig smokers’ urine found at least five of the same carcinogens found in cigarettes. In addition, flavored tobacco products are known to make it difficult to quit nicotine.

The age-standardized prevalence of current and daily e-cigarette use was 6.9% (95% CI, 6.7%-7.1%; weighted sample approximately 15 million) and 3.2% (95% CI, 3.1%-3.4%; weighted sample approximately 7 million), respectively (Table 2). Among individuals who reported current e-cigarette use, the proportion of daily use, as a measure of established use and possible nicotine addiction, was 46.6% (95% CI, 45.3%-48.0%) (Table 2 and eTable 1 in Supplement 1). Many themes in e-cigarette marketing, including sexual content and customer satisfaction, are parallel to themes and techniques that the tobacco industry aimed at youth and young adults in their advertising and promotion of conventional cigarettes. More than 2.5 million U.S. middle and high school students are now using e-cigarettes, with nearly 85% of them using flavored products. An employer, manager or other person in charge cannot fire, refuse to hire, penalize, discriminate or retaliate against an employee, applicant or customer who exercises any right to a smoke-free environment provided under the MCIAA. “Indoor Area” means a space between a floor and a ceiling that is at least 50% enclosed by walls, doorways or windows (open or closed) around the perimeter. A wall includes retractable dividers, garage doors, plastic sheeting or any other temporary or permanent physical barrier. Continuing to monitor flavored tobacco product sales is key to assessing policies like these and informing further policy development and implementation. Food and Drug Administration’s 2009 ban on flavored cigarettes reduced adolescent tobacco use. That’s why California has spearheaded progressive tobacco control policies – not only with SB 793, but through local sales restrictions in dozens of California cities.

The U.S. Preventive Services Task Force, a group of health experts that makes recommendations about preventive health care, has concluded that evidence is insufficient to recommend e-cigarettes for smoking cessation in adults, including pregnant women. Participants were first recruited in May 2021, and data analysis was conducted in December 2022. But it is not responsible for the harmful effects of smoking, and nicotine does not cause cancer. The review process is called “premarket evaluation.” A federal judge ordered the FDA to complete its process by September 2021. Recent youth tobacco surveys found e-cigarette use had surpassed conventional cigarettes as the most commonly used tobacco product among youth. These surveys also revealed that many young people consider vaping to be safe and are not aware that e-cigarettes contain nicotine. It is easy for middle school and high school students to conceal their use of vaping devices because of their appearance as everyday objects.

So when it comes to flavored e-cigarettes, we have this built-in concern about the popularity of those products with kids. But Congress did include mandatory considerations in the Family Smoking Prevention and Tobacco Control Act. And so, by law, when we get one of these applications, we have to consider the product’s impact on existing users of cigarettes and other tobacco products and on nonusers of the product.

The bottom line is e-cigarettes and vapes are unsafe for kids, teens and young adults. Nicotine is harmful to the developing brain and the use of e-cigarettes as a teen increases the likelihood of smoking cigarettes as an adult. The chemical additives and flavoring can also cause unwanted health effects. The electronic cigarette (e-cigarette), for many considered as a safe alternative to conventional cigarettes, has revolutionised the tobacco industry in the last decades.

A 2018 Truth Initiative survey found that mint was among the top three favorite flavors among young JUUL users aged 12-24, meaning they chose it last time they vaped. New research shows that mint and menthol e-cigarette use among high school users rose from 16% in 2016 to 57.3% in 2019. Among high school JUUL users, 67.5% reported that their preferred flavor was mint or menthol. Another study, conducted before JUUL pulled its other flavors from the market, found that mint was one of the most popular flavors among high school student JUUL users, but that menthol was less so.

Before and after the passage of SB 793, our researchers – all posing online as minors under the age of 21 – attempted to buy flavored e-cigarette products from 26 websites that sold them in California. Despite the known risks, vaping has seen a dramatic increase among U.S. adolescents. One of the most popular e-cigarettes is Juul, but hundreds of different e-cigarette brands are currently available to consumers. In June 2022, the FDA banned Juul from selling it’s products after finding the company provided “insufficient and conflicting data” on risks. In light of this spike in youth e-cigarette use, along with the recent U.S. outbreak linked to more than 2,000 lung illnesses and over 40 deaths, the AMA has called for a total ban on all e-cigarette and vaping products that do not meet FDA approval as cessation tools.

Then there are products that were on the market already and that were the subject of an application that was submitted by the deadline, but we haven’t gotten to their application yet. In surveys, more than half of adults who vape nicotine plan to quit. The availability of flavored e-cigarettes is one of the most commonly cited reasons for e-cigarette use among youth (Tsai et al., 2018). Given the importance of flavors contributing to use of e-cigarettes among youth, these data briefs build on this previously published article, providing an update on trends in unit sales of e-cigarettes in the U.S. by product and flavor type. These retail sales data briefs are intended to provide information about population trends in sales for participating retailers; they do not include online sales or vape store sales and cannot be used to make conclusions about subgroup purchasing or behaviors. These estimates are based on the information available at the time of publication and may be subject to updates as more information becomes available.
